1. Agreement to Terms
By accessing this website or engaging DAVILA Web Design for services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree, you should discontinue use of this site and our services.
2. Services
DAVILA Web Design provides web design, development, consulting, and related digital services. The exact scope of work, deliverables, milestones, and pricing will be defined in individual project proposals, statements of work, or written agreements.
We reserve the right to decline projects that conflict with our ethical guidelines or technical constraints.
3. Client Responsibilities
You agree to provide accurate and timely information, content, and feedback needed to complete the project. Delays in providing required assets or approvals may impact delivery timelines and could result in rescheduling or additional fees.
You are responsible for ensuring that any content you supply (text, images, logos, etc.) does not infringe on the rights of third parties.
4. Intellectual Property
Unless otherwise agreed in writing, DAVILA Web Design retains ownership of all underlying source code, frameworks, and reusable components used to build your project. Upon full payment, you receive a license or rights to use the final design and assets for your business as outlined in your project agreement.
You may not resell, redistribute, or claim authorship of our proprietary frameworks, libraries, or design systems without explicit written permission.
5. Payments & Billing
Payment terms, schedules, and accepted methods will be specified in your proposal or invoice. Common structures include a non-refundable deposit to secure the project slot, followed by milestone or final payments upon delivery.
Late payments may delay delivery or result in temporary suspension of work until outstanding balances are resolved.
6. Revisions & Changes in Scope
Each project typically includes a defined number of revision rounds. Requests that exceed the agreed-upon scope, introduce significant new features, or substantially alter the original brief may be treated as additional work and billed accordingly.
7. Warranties & Limitations
We strive to deliver clean, performant, and standards-aligned solutions. However, we cannot guarantee uninterrupted or error-free operation of any website or third-party service integration.
To the fullest extent permitted by law, DAVILA Web Design is not liable for any indirect, incidental, special, or consequential damages arising out of your use of the site or services. Our total liability is limited to the amount you have paid us for the specific project or service in question.
8. Third-Party Services
Projects may incorporate third-party tools, hosting providers, analytics platforms, payment processors, or other integrations. Each third-party service is governed by its own terms and privacy policies, and we are not responsible for their performance or availability.
9. Termination
Either party may terminate an engagement if the other party materially breaches these terms or a project agreement and fails to remedy the breach within a reasonable timeframe. In the event of termination, you remain responsible for payment of work completed up to the termination date.
10. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes in our practices, services, or applicable regulations. The “Last updated” date at the top of this pag
